I hope you enjoy today’s discussion. The following information was provided in detail:
http://www.youtube.com/watch?v=22sNv8bGfrw

1) About Social Security fraud, my question is what’s the punishment when SS or fbi catch these fakes? Do they get 5 years in prison or do they make them pay the goverment back? Is the punishment severe?

I believe someone is committing fraud against Social Security. How do I report that?
Social Security considers reports of fraud very seriously. The Office of the Inspector General (OIG) investigates instances of Social Security-related fraud, waste, and program abuse. To report fraud cases, you can reach us by Internet, mail, fax, and phone.

I think someone may be using my Social Security number. What do I do?
The Federal Trade Commission is the agency that handles identity theft; if you believe your identity has been stolen, you should contact that agency to find out what action you need to take. For general information about protecting your Social Security number, you can refer to our electronic publication, Identify Theft and Your Social Security Number.

You also may want to contact the Internal Revenue Service. An identity thief might also use your Social Security number to file a tax return in order to receive a refund. If the thief files the tax return before you do, the IRS will believe you already filed and received your refund if eligible.

Also, you should file an online complaint with the Internet Crime Complaint Center (IC3) at www.ic3.gov.
The IC3 gives victims of cyber crime a convenient and easy-to-use reporting mechanism that alerts authorities of suspected criminal or civil violations. IC3 sends every complaint to one or more law enforcement or regulatory agencies that have jurisdiction over the matter.

IC3’s mission is to receive, develop and refer criminal complaints regarding the rapidly expanding arena of cyber crime. For law enforcement and regulatory agencies at the federal, state, local and international level, IC3 provides a central referral mechanism for complaints involving Internet related crimes.
The IC3 reflects a partnership between the Federal Bureau of Investigation, the National White Collar Crime Center and the Bureau of Justice Assistance

2) hi anthony i have a question about my case i have been off drugs and alcohol for three years i have anxiety and panic disorder depression and asthma i have mulitiple hospital er visits due to my anxietty panic disorder etc,, i have been found to have drugs in system once in er visit drug test which was a relapse i went to hearing it was brought up in the hearing i told them i had been clean and sober for over a year and go to aa meetings what do you think my chances are ??

§404.1535 How we will determine whether your drug addiction

or alcoholism is a contributing factor material to the

determination of disability.

(a) General. If we find that you are disabled and have medical evidence of your drug addiction or alcoholism, we must determine whether your drug addiction or alcoholism is a contributing factor material to the determination of disability.

(b) Process we will follow when we have medical evidence of your drug addiction or alcoholism. (1) The key factor we will examine in determining whether drug addiction or alcoholism is a contributing factor material to the determination of disability is whether we would still find you disabled if you stopped using drugs or alcohol.

(2) In making this determination, we will evaluate which of your current physical and mental limitations, upon which we based our current disability determination, would remain if you stopped using drugs or alcohol and then determine whether any or all of your remaining limitations would be disabling.

(i) If we determine that your remaining limitations would not be disabling, we will find that your drug addiction or alcoholism is a contributing factor material to the determination of disability.

(ii) If we determine that your remaining limitations are disabling, you are disabled independent of your drug addiction or alcoholism and we will find that your drug addiction or alcoholism is not a contributing factor material to the determination of disability.

3) When I was denied, my lawyer said I may be gettin a letter in about 2 weeks from the ss office…it has been about 2 months and nothing. I called ss office 3 or 4 people told me “over a period of 2 days” that I have been approved by the reconsideration examiner…now it is in the quality review board………..is this good or bad……..what does it mean…

On March 26, 2011, the Wall Street Journal released an article regarding a fraud investigation into the processing of Social Security Disability claims in Puerto Rico. The article provided the following information:

The Social Security Administration’s inspector general is sending a team of fraud investigators to Puerto Rico, following a Wall Street Journal article Tuesday that revealed unevenness in the way disability benefits are awarded around the U.S.

Puerto Rico, a U.S. territory, is one of the easiest places to secure payments from the Social Security Disability Insurance program. In 2010, 63% of applicants there won approval, four percentage points higher than New Jersey and Wyoming, the most generous states.

Puerto Rico’s 00725 ZIP Code includes more people who receive SSDI benefits than any other. Indeed, nine of the top 10 U.S. ZIP Codes for beneficiaries are in Puerto Rico.

This article presents a very unique perspective that I felt was necessary to discuss at this time. Since the Social Security disability process is a federal program, you can move from state to state and continue processing your application for disability benefits because, as a federal program, the standards by which individuals are found disabled are applied the same regardless of where you apply for disability benefits.

Even still, sometimes people will try to locate offices or locations they believe will be more favorable to them receiving disability benefits. The situation in Puerto Rico is a unique phenomenon. Unfortunately, it does highlight an area that is troublesome. I can’t speak on the specific situation in Puerto Rico nor the reason for the unusual ly high number of disability approvals.

But taking Puerto Rico out of the equation, we still have a broader problem. Any time people have the impression they can go to a different location and have a higher chance of getting disability benefits, you have a problem.

It almost goes without saying thatif you go to an area where you have more health resources, you may also have a greater probability of receiving benefits. Under Disability laws, you bear the burden of proving that you are disabled. The reality is that there are numerous people in this country who live in areas where there are very limited health resources. So if you live in an area where you don’t have access to a free health clinic or low income health clinic, you may have a better ability to prove you’re disabled if you relocate to an area that has a better local healthcare system.

If you go to an area with a lot of social services, you may experience a greater probability of receiving benefits.

I can’t say this enough: If you’e trying to prove you’re disabled but don’t have health insurance and no financial means to support yourself, your greatest asset is the social services arena. Whether you go to the county, the city or even some charitable organizations, these services are designed to connect you with the resources you need in order to prove you are disabled, as well as help you survive. Naturally, some areas are better than others, so if you happen to be in an area that has a better and stronger social services network, these resources may provide a greater avenue to support you in proving that you are disabled.

If you’re going someplace where they process Social Security cases a lot faster, again, you may experience a greater probability of receiving benefits. Every place processes Social Security disability benefits differently in terms of speed time. If you have a larger population, it’s going to take longer to process an application. If you have more offices, you may have a shorter period to process cases. The processing time has nothing to do with quality as much as sheer statistics.
Be careful about deciding to shop for an office you think will get you approved. In the end, all offices are processing under the same standards.

Please listen to today’s show to listen to the response for the following questions:

1. How can a person on disability, especially after 7 years, expect to be treated as equals returning to the workforce and or school?

2. Does the employer get a break from the government somehow by employing these people and or is denying these people discrimination?

3. Do they look at one of my conditions or all of my impairments? right now i will take it on any grounds and would probably get it on mental at this point, so what ever would be the strongest case migraines, fybro, depression or irriatable bowel. would they look at it as a combination?

4. Why don’t people say what the real deal for denial is? Fraud. It’s the biggest reason we have the issues we do for those of us with real disabilities. Also, in my denial letter, is the statement from a Dr. who finds me completely disabled. There were 17 discrepancies or contradictions in the “facts” sheet of the denial.

5. How do we report this fraud?
