    This stuff is so mindboggling. I waited over 3 years for my hearing, which was in march. It’s now August and I still haven’t received a written determination. It seems you’re saying theres no time limit on how long these people have to tell determine my case, so am i looking at another 3 years of waiting? (I’m in michigan, if that helps)

    I recieved my Letter Fully Favorable last week. I have 2 questions. I live in NYS and I and my Son who Turned 18 this past July have been living on Social Services. Will they keep my 1st check or a portion of it? I have had to borrow about 5000.00 from friends in the 2 years it took to get my case heard and want to pay them back. also have purchased any clothes for myself in 2 years. The Second is will I collect for mt Son as I said My disability goes from Sept 30 2007. MY Son lives with me and turned 18 july 3rd 2009. He starts a local Comunity College in Sept. so will I collect for Him? If so until he’s 18 or longer if he is in college, Thank You,

    The ALJ issued a “bench decision” of Fully Favorable on 10/1/2009 and I received my letter on 10/3/2009. What can I next expect to happen? Will the attorney be paid first then the remainder to me? Who pays me, the check from SSDI to attorney, then they cut me a check minus their fees? Does SSDI pay them then I get the remainder? What exactly DOES come next?

    I went before a ALJ for a hearing on July 23rd of 2009 after filling July 23rd of 2007 on September 12th of 2009 I recieved a fully favorable award it is now October 22nd and I have not recieved one penny or heard one word from SSA. I called my local office since my case is SSI only and your local offices handle the SSI only cases. They told me one month to three months about a week ago around October 15th, but the Award letter I recieved said the local office would be contacting me within the 60 day limit, to make sure I have not inherated or recieved any new money since I applied. I have not not except for what I have been forced to borrow from family and friends that I will pay back from my back pay money because of such a long wait. If you case is SSDI only and your onset date was July of 07 they make you wait 6 months if I’m right so for SSDI if nothing gets lost in the “system” you will get your first check in Jan. of 2010. Then you will have to wait another two years for Medicare from the onset fate that is on your award letter. I’m not a lawyer but this is how my case has went and I know several others that are the same story as mine except I did not have to wait as long for a hearing as I di. The best way I can judge it the award letter is about the half way point into getting any real money. At least thats how my case is going. Everybody’s case moves at different speeds and for that one I can’t help. I hope this has helpped and not confused you even more.

I have had a tbi ( traumatic brain injury) and i suffer from digenerative disc disease and i also have arthritis in my lower back my mental capability is around 12 years old even though im 21 i was in a hit n run when i was 13 years old so what would you think my chances of winning my ssi case would be?

    I was on SSI from 94 to Nov 2002. I reapplied to go on Disability but due to being over the income guidelines I filed for SS-DI.

    In July I got a Fully Favorable decision and soon after an Award Letter.

    The benefits have been suspended (never arrived) becuase the local office says my claim has to now be reviewed by the Disc. Determination Unit.
    The Determination Unit says they have lots of cases and I will have to wait 3 to 4 months.

    They are treating my case like a brand new claim and not using any medical evidence before Jan 07.
    I have been told my initial folder/case was lost.

    I have CFS and stopped going to MD’s because they can’t cure CFS.

    So Fully Favorable decision in hand but being told that the decision was reversed. When I ask by whom- I get no answer!

  12. On occasion, the Social Security Administration will conduct a review of it’s decision in the event that they determined that a disability determination needs to be reviewed. Unfortunately, the only remedy you have available is to appeal the decision if they reverse the decision after determining that a disability award was not warranted.

    Mine is a confusing one.In 1999 i applied for SSI, was approved and then a month later was told they made a mistake and withdrew their decision. After that i tried to work many times but could not.After many hospitolizations i applied again on feb 2007. I was denied,i appealed. I finally had my hearing october 2009. My attny say’s he is trying for both SSI and or SSDI. At the hearing the Work specailst told the judge when asked if i could work any jobs with my conditions she replied “none” judge. The judge then says i will hear a decision in 4 weeks. It has been 3 months and 2.5 weeks and i keep getting the same answer that its at the decision level!!!Ive been getting that same response since november. I am so frusterated, especially after reading some of your posts knowing who knows how long i have to wait for my decision,let alone waiting 6 months b4 i see ANY money??? This seems like a nightmare.

  14. I always tell people that the most frustrating part of the process is the waiting. The hard part is that once the case is at the hearing level, there is really nothing you can do because you are bound by the judge’s timeline. Most people don’t realize that the Judge’s have a severe backlog and their staff is the one drafts the decision once it’s done. It’s not a pleasant part of the process but it is one that you must accept. Unfortunately, the tough part is that you can’t rush the judge. All you can do is patiently wait for the written decision.

    02/01/10: Hi, My questions may seem confusing, but in trying to research thm it seems more confusing. Here goes. On 01/13/10, by out of court settlement, the ALJ has awrded me full disabilities for to many medical problems which some will require female surgey. and thyroid low count etc.. I became disable on 07/15/08, became married 04/30/09 have a step son that has ADD?HD since early child hood &asthma he is 15yrs. plus two sons plus two other step sons from 1st marriage all boys which they also have ADD/HD plus asthma.My youngest son now 22 is getting ssdisability. so is the youngest from ex husbands fist marriage ex-husband is also of age 68 gets SS . Now my oldest son also has a drug problem which I feel coms frombeing on drugs since 5years old which has cused him into harder drugs over the years, also jail time so let’s say in and out of county jail, knowing all of this what can you tell me Please.. I have not received any letter yet “Notice of Award Letter” hearing was again 01/13/10. Now my new husband and son live in Al. My ex-husband and all children are 22 and older. So now what will of these facts effect my disability. I will be drawing off from my own records. Thank You. It’s so confusing.

  17. Well, your situation has two really quick answers:
    1) Even if the judge approves you on the record, a written decision still takes a few months because the courts have only a limited number of writers. So it is important for any person who gets approved AT the hearing to understand that a written decision will not over night.

    2) Social Security Administration has several programs but the two most common are Supplemental Security income and the other is Disability Insurance Benefits. Supplemental Security Income or SSI is income / resource sensitive which means any resources or income may affect how much money a person may receive from SSI. DIB is a little different. Typically income or resources don’t affect it (unless a person is receiving Workers Compensation or VA benefits).

    i too suffer from a tbi things are very very bad abt to be homeless. hearing is set for march 29th accident happend on march 11 08 i have already filed a hardship affidavit. realistically speaking nothing as far as money if I do win for several mor mnths correct ? will the approved hardship affidavit expedite or help any…(i am adams friend and am typing this for him.)he gets confused after trying to concintrate for to long. any help would be greatly appreciated.

  19. It’s important that when you are at a hearing to make sure the judge knows if you are in a ‘critical financial situation’. However, a judge is not going to rush through a case if the judge thinks that there may be more medical evidence that needs to be obtained. As such, it’s important to make sure that your file is up to date before you go into the hearing to prevent any delays. Still, it’s important to remember that even if a case is designated as critical, it may take a month or longer to get a written decision. If a person has a representative, sometimes (if the judge approves the case there), the judge will permit the representative to write the decision (this will go a long way towards speeding up the process).
